TREETOPS LOYALTY REWARD GENERAL TERMS & CONDITIONS
Treetops Loyalty Reward is a Treetops Membership and Loyalty Programme, hereafter referred to as the “Membership” that is managed and operated by Treetops Executive Residences, hereafter referred to as the “Company”.
Individuals who have successfully registered for a Membership in accordance with these Terms & Conditions are hereafter referred to as “Member(s)” and are entitled to earn Treetops Dollars (“TT$”), which can only be earned, stored, transferred and used in accordance with these Terms & Conditions.
These Terms & Conditions represent a legally binding agreement between the Company and a Member. Notwithstanding the lack of a signed acceptance by the Member, the Member shall be deemed to have read and agreed to be bound by these Terms & Conditions upon the submission of the relevant form for registration of the Membership in accordance with Clause 1 of these Terms & Conditions.
1. Membership Enrolment
1.1 Only natural persons aged 18 or above may be a Member. Membership shall not be extended to corporations or any other legal entities.
1.2 Membership enrolment shall –
a) be made online at the Treetops Loyalty Reward website (www.treetops.com.sg/loyaltyreward) by filling in an online Membership registration form; and
b) only be processed by the Company where all mandatory fields in the online Membership registration form marked with asterisks are completed correctly.
1.3 There is currently no enrolment fee for the Membership.
1.4 An individual shall only become a Member upon –
a) verification of their email address; and
b) receipt of an email disclosing their Treetops Loyalty Reward Online Membership Portal (www.crm.treetops.com.sg/login/) login username and associated MemberID (“Membership Confirmation Email”).
1.5 The Company reserves the right to grant or refuse Membership at its sole and absolute discretion.
2. Membership Tiers and Benefits
2.1 The Treetops Loyalty Reward offers two Membership tiers – Superior and Premium. All new Members join as Superior Members, the entry tier for the programme.
2.2 Superior Members shall be upgraded to the Premium Member tier if they accumulate TT$2000 from Qualifying Stays within a period of twenty-four (24) months. The first twenty-four (24) month period begins from the date of the Member’s receipt of the Membership Confirmation Email.
2.3 The Premium Membership tier is valid for twelve (12) months from the date which the Member is upgraded and is automatically renewed upon accumulation of TT$500 within the twelve (12) months of Premium Membership. Any TT$ in excess of the TT$2000 required for Premium Membership qualification before the upgrade takes place shall not count towards Premium Membership renewal.
2.4 If the conditions for renewal of Premium Membership are not met, the Premium Membership will be reverted to Superior Membership.
2.5 Members are entitled to a percentage discount upfront on Qualifying Stays made on the Treetops official website:
a) Superior tier: 5% discount upfront
b) Premium tier: 8% discount upfront
2.6 For every SGD10 spent on Qualifying Stays and extensions on Qualifying Stays made through the Treetops Guest Services (in accordance with Clause 5.4), Members can earn as follows:
a) (Qualifying Stay via Treetops official website) Superior: TT$0.50 for every SGD10
b) (Qualifying Stay via Treetops official website) Premium: TT$0.80 for every SGD10
c) (Extensions on Qualifying Stay via Treetops Guest Services) Superior: TT$0.50 for every SGD10
d) (Extensions on Qualifying Stay via Treetops Guest Services) Premium: TT$0.80 for every SGD10
2.7 Premium Members are also entitled to the following privileges:
a) Free cancellation of booking up to seven (7) days before arrival date;
b) Complimentary one-way airport pickup;
c) Complimentary local newspapers;
d) Fifteen percent (15%) discount on F&B;
e) Fifteen percent (15%) discount on laundry services;
f) Early check-in from 1 am and late check-out up to 12 midnight (subject to availability); and
g) Welcome bottle of wine and fruit basket.
2.8 Accumulated TT$ are for the sole purpose of determining tier status and such criteria may be changed from time to time at the sole and absolute discretion of the Company.
3. Memberships Personal to Individual Only
3.1 Memberships are non-transferable.
3.2 A Membership may only be used by the Member and cannot be shared with or used by anyone else to earn TT$, benefits, promotion bonus points or to upgrade Membership tiers.
4. Membership Profile Tracking & Account Statement
4.1 Members may log onto Treetops Loyalty Reward Online Membership Portal (www.crm.treetops.com.sg/login/) which allows Members to track their membership status, update their particulars and consent to receiving marketing materials.
4.2 Members will receive a regular Membership e-Statement showing the balance of their TT$ with a summary of activities they have earned or redeemed. Any discrepancies in the statement have to be raised by email to membership@treetops.com.sg within ninety (90) days from the actual date of the transaction.
4.3 Account transactions and TT$ accumulated in the past twenty-four (24) months are listed separately from the TT$ available for redemption, both in the Member’s Account and on the account statement.
5. Award of TT$
5.1 TT$ may only be awarded to a Member for a Qualifying Stay (as defined in Clause 5.2) that is billed in that Member’s name and paid for by that Member using payment instruments (e.g. credit cards) which precisely match the Member’s name.
5.2 A “Qualifying Stay” refers to a –
a) fully paid, non-cancelled stay;
b) booked by a Member through their Membership account on the Treetops official website only (and not through other reservation channels or third-party platforms);
c) for personal stay; and
d) that has fulfilled all the Terms & Conditions of the Treetops Loyalty Reward and is compliant with Treetops Terms & Conditions of stay.
5.3 All extensions of stay beyond a Qualifying Stay –
a) shall not qualify to earn rewards and/or benefits unless done through Treetops Guest Services; and
b) are subject to availability and prevailing rates.
5.4 For the purposes of calculating the TT$ to be awarded in respect of a Qualifying Stay and where applicable an extension of stay made through the Treetops Guest Services,
a) a Member’s spending shall be –
i) denominated in Singapore Dollars;
ii) converted to TT$ at a pre-determined rate specified at Clause 2.6 which may be updated at any time at the sole and absolute discretion of the Company; and
iii) rounded to the nearest TT$ based on the gross rate before prevailing tax.
b) Any spending in relation to government and local taxes, service charges, all incidental charges (e.g. tips, extra beds, telephone charges, television channels, food & beverage charges, business centre charges, transportation, damages), any other third-party services contracted out by the Company such as laundry services, function room charges, events spending, early check-in fee, late check-out fee, cancellation penalties and any other miscellaneous charges shall be disregarded.
5.5 TT$ will only be awarded upon check-out of the Member, and will be credited into Member’s Account up to seven (7) working days (which shall exclude Saturday, Sunday and public holidays in Singapore) after Member completes their Qualifying Stay.
6. Bonus Awards of TT$
6.1 A Sign-up Bonus of TT$50 will be automatically credited into the Member’s account upon successful membership application.
a) The Sign-up Bonus is non-transferable and is valid only for 12 months from date of Membership activation.
b) The Sign-up Bonus will be auto-redeemed upon Member’s first online booking for a Qualifying Stay after login.
c) The Sign-up Bonus will be forfeited and will not be refunded if Member cancels their first booking.
6.2 A Birthday Bonus of TT$50 will be awarded to Members with an active account annually. Members may redeem the Birthday Bonus for a Qualifying Stay with a check-in date during the Member’s birthday month.
a) The Birthday Bonus will be auto credited into Member’s account, once every calendar year.
b) During the Member’s birthday month, the Birthday Bonus will be first applied towards any redemptions made by the Member, before any other TT$ owned by the Member is used.
c) The Birthday Bonus is non-transferable and is valid only till the last calendar day of the Member’s birthday month.
6.3 If a Member refers an individual to sign up for the Membership, a one-time Referral Bonus of TT$50 will be accorded to the Referrer (existing Member), upon the New Member completing their first Qualifying Stay. The New Member must quote the Referrer’s Membership Number upon registration.
a) The Referral Bonus is non-transferable and is valid only for 12 months from date that it is first credited into Member’s account.
b) There is no limit to the number of referrals a Member can make.
7. Transfer of TT$
7.1 Membership and TT$ have no monetary value and may not be bought, sold, bartered, exchanged for cash or traded otherwise by any means. However, unless otherwise stated in these Terms & Conditions, Members are allowed to transfer TT$ to friends or relatives who are existing/new Members.
7.2 Transfers of TT$ are to be done through the Treetops Loyalty Reward Online Membership Portal (www.crm.treetops.com.sg/login/) only. Members making transfers remain solely responsible for any TT$ transferred. The Company shall not be liable for any failed, erroneous, unintentional, or fraudulent transfers.
7.3 Members are only permitted to transfer their full balance of TT$ to other Members and shall not make any partial transfers of their balance of TT$.
7.4 TT$ that is transferred from a Member (“Transferor Member”) to another Member (“Transferee Member”) retains the original expiry date from the date that the TT$ are credited into the Transferor Member’s account. If those TT$ have an earlier expiry date than the other TT$ in the Transferee Member’s account, those points will be applied towards redemptions by the Transferee Member first, before any other TT$ owned by the Member is used.
8. Redemption of TT$
8.1 TT$ are valid for redemption –
a) as soon as they are credited to the Member’s account; and
b) for twelve (12) months from the date that it is credited into the Member’s account, after which the TT$ is deemed expired and unredeemable.
8.2 Redemption of TT$ for stays can only be made through the Treetops official website prior to payment.
8.3 Except where otherwise provided in these Terms & Conditions, all redemptions of TT$ shall be credited to the Member’s account on a first-in-first-out basis.
8.4 TT$ shall only be redeemed to –
a) offset room rates for online bookings made through Treetops official website for stays that are:
i) Qualifying Stays; and
ii) a minimum of six (6) nights.
b) not be used to offset any:
i) extension of an initial Qualifying Stay; or
ii) cancellation charges or penalties, where applicable.
8.5 Redeemed TT$ are to be deducted against the amount charged by the Company excluding any prevailing tax.
8.6 The Company reserves the right to exclude specific items or periods of stay from being redeemed with TT$ at its sole and absolute discretion.
8.7 In the event of a valid cancellation in accordance with the cancellation policy displayed on the Company’s booking page or such further location as the Company may specify in any update to these Terms & Conditions, TT$ redeemed will be credited back to the Member’s account subject to cancellation charges, if any. TT$ credited back, if any, will retain the original expiry date.
8.8 Cancelled stays that are partially refunded are not eligible to earn TT$ and the TT$ redeemed for that stay will be forfeited (if any).
9. Incorrect Debit or Credit of TT$
9.1 If the Company incorrectly denies TT$ to a Member, the Company’s only liability will be to provide the Member with the amount of TT$ originally denied. Missing TT$ request made to membership@treetops.com.sg will only be accepted for processing within three (3) months of the original transaction date.
9.2 If the Company credits an incorrect amount of TT$ to a Member’s account, the Company reserves the right at any time to cancel or invalidate the TT$ recorded incorrectly in the Member’s account.
10. Status of Membership and TT$
10.1 The Company has sole and absolute discretion over Memberships, TT$ and all matters pertaining to such Membership and TT$.
10.2 For the avoidance of doubt, the Company reserves the right to amend or forfeit any amount of TT$ from Members without penalty.
11. Termination and Suspension of Membership
11.1 A Member may terminate their membership by providing written notice to the Company via email to membership@treetops.com.sg.
11.2 A Membership account shall be automatically terminated in the following circumstances:
a) where for a continuous period of thirty-six (36) months, there is no Qualifying Stay associated with that Membership account; or
b) upon the death of the Member to whom that Membership account belongs.
11.3 The Company reserves the right to suspend, withdraw and/or discontinue Membership rights and benefits, including, without limitation, suspension of a Member’s access to electronic login accounts or de-activation of such login account, if the Company has reasonable grounds for suspecting, in its sole discretion, that a Member has:
a) acted in a manner inconsistent with applicable laws or regulations;
b) acted in a manner inconsistent with, breached or violated any of these Terms & Conditions;
c) engaged in any fraudulent, dishonest or deceptive behaviour, theft, misconduct or wrongdoing in connection with their Membership account, including, without limitation, the involvement of reward redemption or other Member benefits; or
d) failed or refused to pay any bills or accounts due to the Company.
e) The measures set out above shall result in a Member’s loss of accumulated TT$, the cancellation of Membership benefits and privileges and/or a downgrade of Membership tiers. In addition, the Company shall have the right to take appropriate administrative and/or legal action, including, without limitation, criminal prosecution, as it deems necessary in its sole discretion.
11.4 The Company reserves the right to terminate a Member’s Membership account with immediate effect if:
a) that Member inadvertently creates a duplicate account, or simultaneously holds more than one Membership account;
b) that Member is involved with using any TT$ in an unauthorised sale, barter, trade or prohibited exchange;
c) that Member allows anyone else other than the Member to use his or her Membership account to earn TT$, benefits, promotion bonus points or to upgrade Membership tiers;
d) the Company in its sole discretion decides to shut down or terminate all or part of the Treetops Membership and Loyalty Programme; or
e) where the Company chooses to do so at its sole and absolute discretion.
11.5 Upon termination of a Membership account, all benefits and privileges associated with that Membership account shall immediately cease and all awarded and outstanding TT$ of the Member shall become void.
12. Limitation of Liability
12.1 Except for death or personal injury caused by the Company’s negligence, the Company and its affiliates accept no liability and shall not be responsible for any indirect, consequential, special, economic or exemplary losses or damages howsoever they may arise, whether foreseeable or otherwise with respect to or arising from the Member’s participation in the Membership or use of TT$.
12.2 The Company shall not be responsible for any taxes, levies or duties that arise in connection with Members’ participation in the Membership or benefits, and any and all additional costs shall be borne by the Member.
12.3 To the extent permissible under applicable laws, Members agree to release the Company, its affiliates, and programme partners from any direct or indirect loss, claims, costs, damages or expenses of any kind whatsoever arising out of or in connection with his or her Membership.
13. Privacy and Data Protection
13.1 The Company’s Privacy Policy is deemed to be incorporated into the contract between the Company and a Member.
13.2 All information disclosed by a Member to the Company will be managed by the above said Privacy Policy. A copy of the Privacy Policy can be found by visiting the Treetops website at (www.treetops.com.sg/privacy-policy/).
13.3 The Company requires Members to provide certain personal data in order to ensure the continued operation of Treetops Loyalty Reward, related frequent guest programmes and compliance with applicable laws and regulations. The Company is not responsible for any loss or failure to deliver Treetops Loyalty Reward Membership and associated benefits as a result of a Member’s failure to provide the Company with up-to-date data. This includes services such as TT$ or booking tracking, management and issuance.
13.4 Members may review their personal data by accessing their Membership profiles on the Treetops Loyalty Reward website. Updates to personal data can be done by writing in to membership@treetops.com.sg.
13.5 Members are required to create their own confidential password when activating their online accounts. Members must ensure that this password is not disclosed to any parties. The Company cannot be held liable for the consequences of any disclosure of the password by Members or unauthorised or fraudulent transactions.
14. Amendments and Variation
14.1 The Company reserves the right to –
a) modify the Membership structure, benefits and other features of the Membership;
b) (without supplying or providing further consideration) amend and update these Terms & Conditions; or
c) terminate the Membership programme at any time in its sole discretion.
14.2. Any amendments or updates to the Terms & Conditions will take effect without the need for notice to be given to Members and from the date that the amended or updated Terms & Conditions are uploaded at (www.treetops.com.sg/loyaltyrewardterms). It is the sole responsibility of Members to keep themselves up-to-date in respect of these Terms & Conditions by regularly reviewing the Terms & Conditions at the Treetops official website (www.treetops.com.sg/loyaltyrewardterms) to ensure that they are familiar with the most recent version.
14.3. Any use of a Member’s Membership account shall be deemed to be that Member’s acceptance of the most recent version of the Terms & Conditions. The sole and exclusive remedy for Members who do not agree to the most recent version is to terminate their Membership, by giving notice in writing to the Company. Any unexpired or unused TT$ will be deemed to be extinguished on termination, and the Member shall have been deemed to release the Company from any claims or liabilities of any kind in connection with these Terms & Conditions and any TT$.
15. Non-waiver: The Company retains its right to exercise or enforce any right contained in these Terms & Conditions. In the event that the Company fails to take action, it shall not be deemed as a waiver of its right or prevent it from taking subsequent action in respect of that right or of any other right.
16. Interpretation
16.1 If the English version of these Terms & Conditions conflicts with any other language version, the English version shall prevail.
16.2 All interpretations of these Terms & Conditions shall be at the sole and absolute discretion of the Company. In case of dispute over the interpretation of these Terms & Conditions, the Company’s decision is final.
17. Governing Law: These Terms & Conditions are governed by law of Singapore.
18. Dispute Resolution: Any dispute arising out of or in connection with these Terms & Conditions, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre (“SIAC”) in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (“SIAC”) for the time being in force, which rules are deemed to be incorporated by reference in this clause. The seat of the arbitration shall be in Singapore. The Tribunal will consist of 1 arbitrator. The language of the arbitration will be English.
